1.0 GUIDANCE NOTES - PLEASE READ 1.1 Your valued custom is important to us and we want to satisfy your purchasing requirements. These Terms and Conditions of
Sale ("the Terms") are important to you and to The PC Centre ("THE PC CENTRE") and should be considered carefully before you
place an order with us.
1.2 These Terms have been designed to protect your rights as a valued customer, to protect our rights as a business and to
create an understanding between us
1.3 The Terms apply to all transactions carried out on The PC Centre website and through our telephone order system.
1.4 Please note carefully Section 3 which refers to our Returns Procedure, and Section 4 which details our obligations
under the Distance Selling Regulations.

customer number on the e-mail. This can be found on top of your last invoice.
1.6 For purposes of the Terms "company", "we", "us", "our" refer to The PC Centre and "you", "client" and "your" refer to
you the Customer unless the context clearly indicates otherwise. "The Agreement" means the contract between The PC Centre
and the Client to which these conditions will apply. "The Order Form" mean the digital or printed document completed by
the client in order to enter the Agreement. "Order" is the request by the Client for products and/or services in the order
form/agreement. "Completion of site" means 5 days from the site being uploaded to a temporary server, for approval by the
client, without notification from the client that the site is unsatisfactory. "Deliverables" are the outputs of services
to be supplied under the agreement and shall include but are not limited to, all software and written material, including
programs, tapes, listings and other programming documentation.

2.0 PURCHASING FROM US 2.1 To purchase from us you must be 18 years or older. You must be resident in the United Kingdom, the Channel Islands
or the Isle of Man.
2.2 We are not obliged to supply the goods or services to you until we have confirmed acceptance of your order. It is on
our acceptance that a contract comes into effect between us.
2.3 Ownership for the goods transfers when we have been paid in full and delivery has taken place. This does not affect
your statutory rights.
2.4 If you fail to make any payment as agreed the outstanding sum plus interest from the original date of invoice becomes
payable immediately. No further notice of legal proceedings will be issued.
2.5 All products are supplied subject to availability. In the event that we are unable to supply any product, we will
inform you of this as soon as possible.
2.6 All sizes and dimensions are approximate but we make every effort to make sure they are as accurate as possible.
3.0 RETURNS PROCEDURE 3.1 We hope that you will be completely satisfied with your product. However, it may be necessary to return your product
to us in some limited circumstances. Please ensure that you follow these instructions for returning a product to avoid a
delay in processing your return. Other than as required by law we have no general policy of accepting returns.
3.2 Returns will not be accepted unless you are issued with a Returns Authorisation Number. This number can be obtained
by contacting our Returns Team. Please click here to go through The PC Centre contacts
3.3 You the Customer are solely responsible for inspecting the product upon delivery. You must contact The PC Centre
should you wish to inform us of damaged, defective or missing goods and/or delivery discrepancies within 48 hours of your
delivery being made.
3.4 When sending a return to us, you are responsible for the safe carriage of the product back to us. We can, however,
arrange to have the product collected, which will involve a charge payable by you. The exact charge for collection will
be confirmed to you when you obtain your Returns Authorisation Number from our Returns Team. You will pay a re-stocking
fee of 20% of the cost of the product.
3.5 Any product returned to us must be returned with all associated items originally sent as part of the product and in
the same packaging. This list (which is not exhaustive) includes all instruction booklets, manuals, cables, disks and free
software.
3.6 Refunds will be processed within thirty [30] days from the date you tell us of a product return and refunds will not be
issued until the product has been received by us in its original or delivered state.
3.7 You should return any product to us via a suitably insured means based on the value of the product. This means that the
full value may be recovered by you if the product is lost or damaged. You should retain any receipt confirming the return. If
returned products are lost we will not be liable for them.
3.8 Prior to agreeing to any return we reserve the right to inspect the product at your home or premises if we consider this
necessary.

4.0 DISTANCE SELLING REGULATIONS 4.1 Under the Distance Selling Regulations you have the right to cancel your order for any item purchased on our website or
through our sales team and claim a refund, except for custom built PC systems. This right does not apply in the case of audio
or video recordings or software where the seal has been broken. This does not affect your statutory rights.
To cancel your order you must notify us as required in Clause 4.2 within seven [7] working days following the day of delivery.
You must return the product to us as required by these Terms but if you do not or if you return the product at our expense we
may charge you the reasonable costs of returning a product except in the case of cancellation of substitute products.
4.2 Should you wish to exercise your rights under the Distance Selling Regulations your order may only be cancelled in
writing, by fax or by e-mail. Telephone cancellations cannot be accepted. You can contact our Returns Team.
4.3 The goods must be returned in an unused and re-saleable condition. You are responsible for the cost of safe carriage back
to us. You are strongly advised to arrange for adequate insurance to cover the product during its return journey.
4.4 The product should be returned within seven [7] working days from the date we receive your cancellation. If you are unable
to return the product to us within seven [7] working days you must contact us to arrange a collection which will be at your cost.
4.5 You may cancel Services in the same way, within seven [7] days of purchase, unless the services begin sooner. The Distance
Selling Regulations do not apply to financial and insurance services.
4.6 Software, Video, Video Games, Games or Audio recordings can only be returned if the seal on the product is completely
intact. The only exception to this is if the product is faulty or misdescribed. Should this be the case, please contact our
Returns Team.
5.0 DAMAGED, DEFECTIVE OR FAULTY GOODS 5.1 Any product supplied to you must be used for its intended purpose and not be subject to abuse or unreasonable usage.
5.2 The PC Centre or our authorised agent will repair or replace any product that has failed in normal usage as long as
the product has been used as intended and does not, on examination, display any signs of misuse.
5.3 Should we attempt to repair the product and find that no inherent manufacturing fault exists, we will return the
product to you and charge you 50% of the products selling price to cover the cost of the testing process.
6.0 UNWANTED OR INCOMPATIBLE GOODS 6.1 We are not obliged to accept the return of a product unless covered by the Distance Selling Regulations as outlined in
Section 4 and you have notified us of cancellation in writing within seven [7] days of delivery, except where the product
is faulty or misdescribed.
6.2 We are entitled, subject to our discretion, to accept products that are unopened and unused subject to the deduction
of a handling and administration fee of 20%. To find out whether this will be possible, please contact our Returns Team.
6.3 Should we authorise the return of an unwanted or incompatible product, you are responsible for the cost of safe
carriage back to us. Furthermore you are advised to organise appropriate insurance to cover the return journey.
7.0 PRICES AND PAYMENT 7.1 Where limited offers are advertised, these products are subject to availability and are allocated on a strict first
come first served basis. When all the stock of these products has been allocated, no substitute product will be offered.
7.2 We have selected our products on the basis that they will be used for domestic use only. If you are planning to use
them for business purposes please make sure that you have appropriate insurance. The PC Centre accepts no liability
whatsoever where products are misused or not used in accordance with instructions.
7.3 All prices are in pounds sterling (£). The price you pay in pounds sterling (£) is the price displayed on The PC
Centre website or the price agreed with a member of The PC Centre team. While we try and ensure that all prices on our
website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform
you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we
are unable to contact you we will treat the order as cancelled. If you cancel before the goods are despatched to you and
you have already paid for the goods, you will receive a refund, but you may still incur a cancellation charge.
7.4 Payment can be made by any method specified in our Payment Options section, which is located on our websites help
page. We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are
negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by
you.
7.5 Any advanced payment for goods or services ordered will be considered as a non refundable deposit by The PC Centre
Ltd. The customer cannot cancel any order unless the customer pays any losses or costs The PC Centre suffer as a result.
There is no statutory cooling off period.
7.6 Full payment for the goods ordered must be made on date of delivery of goods. Full payment of goods must be cleared,
before the goods are transferred to the customer.
7.7 Compensation for debt recovery costs in relation to late payment – The PC Centre Ltd are entitled to claim
compensation when a debt remains unpaid after the date specified on the contract, or in the absence of a contract, 30
days after the delivery of the goods or service. Please refer to Directive 2000/35/EC of the European Parliament. The
compensation entitlement varies in accordance with the size of the debt:

8.0 DELIVERY 8.1 Delivery charges and estimated timescales are specified in our Delivery Options section.
8.2 Delivery should be achieved within thirty [30] days. We make every effort to deliver goods within the estimated
timescales, however delays are occasionally inevitable and time for delivery will not be of the essence. We will
endeavour to keep you informed of any delay to your expected delivery date.
8.3 You are responsible for ensuring that the dimensions of your product(s) and the delivery destination are
suitable for delivery. Should it transpire that a product will not fit into the delivery address and you subsequently
cancel the order, a restocking and handling fee of 20% will apply. Where delivery has been attempted, your delivery
charge will not be refunded.
8.4 Local delivery is defined as a delivery to an address within a 10 mile radius of The PC Centre Ltd.
9.0 COMPUTER PRODUCTS 9.1 You are responsible for ensuring that any product you purchase from us is designed to work with your computer
system and operating system. If you are unsure about compatibility with your own computer system and operating system,
please contact our Technical Services team. Please refer to the manufacturer for the optimum advice.
10.0 GENERAL 10.1 We will not be liable to you for any claims which arise out of the supply of our products to you unless we are
negligent but we will not be liable in any event for any consequential loss, except where this is required by law.
10.2 We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we
are negligent, we are not liable for losses as a result of unauthorised access to information provided by you.
10.3 We hereby exclude the application of the Contracts (Rights of Third Parties) Act 1999 to each and every
contract made under these Terms.
10.4 These Terms cannot be altered or suspended, permanently or temporarily, without the written permission of a
member of the Board of Directors of The PC Centre.
10.5 These conditions are subject to English law and the jurisdiction of the English courts.
11.0 WEBSITE COMPATIBILITY 11.1 We do not guarantee that this website will be compatible with your PC, and we accept no liability for any
corruption or loss of data held on your PC, or any liability for any other loss or damage of any kind caused to
your PC resulting from use of this website.
12.0 WEBSITE SERVICES PROVIDED BY THE PC CENTRE 1) Scope: This agreement shall apply to all goods placed at the residents of The PC Centre and/or services
ordered by the client from The PC Centre.
2) Payment: A deposit of 50% of the total fee is due with order, unless otherwise agreed, in which case
payment is due upon completion of site. Whilst any payment due under the agreement remains outstanding, The PC
Centre shall be entitled at its sole and absolute discretion to withhold provision of any goods or services it
would otherwise be obliged to provide under the agreement.
3) Liability: The PC Centre hereby excludes itself, its Employees and or Agents from:- all and any liability
for loss or damage caused by any inaccuracy; omission; delay or error, whether the result of negligence or other
cause in the production of the web site; All and any liability for loss or damage to clients artwork/photos,
supplied for the site. Immaterial whether the loss or damage results from negligence or otherwise.
4) Copyright: Any web page; design or entire site designed by The PC Centre carries a copyright, and cannot
be reproduced without written consent. The placing of an order by the client or other person/Agency on behalf
of the client constitutes a guarantee that all necessary authority and permissions have been obtained in respect
of the artwork, design and photographs, for use in the advertisement. The Advertiser/customer must indemnify The
PC Centre in respect of all actions; proceedings; costs demands and claims arising from any such breach.
5) Precautions: Advertisements must comply with the Business Advertisements (Disclosure) Order 1997 and the
Trade Descriptions Act 1968.
6) Delivery: on completion of work, the deliverables will be uploaded to the client area for approval under
the terms of the guarantee. Upon written approval by the client, the deliverables will be uploaded to the clients’
server. Where the clients site is being hosted by a third party, The PC Centre reserve the right to delay uploading
of deliverables until full payment has be received.
7) Guarantee: In the event that the client is not satisfied with the design of their site they are entitled to a
full refund of the design fees. Additional charges including but not limited to: stock photography; electronic
commerce software; online transaction processing solutions; domain name registration; web space; Internet connection
provided by third parties are non refundable.
8) Refunds: cancellations must be made within 5 days of the client viewing the completed web site otherwise no
refund can be made. Cancellations made within 5 days, may be subject to a charge, if expenses have been incurred in
respect of additional expenses from third parties including but not limited to: stock photography; electronic commerce
software; online transaction processing solutions; domain name registration; web space; Internet connection. Where
possible third party products will not be purchased until the design has been approved. All such cancellations must
be in writing within 3 days of the client viewing the completed web site, otherwise refunds will not be entertained.
9) Acceptance of Conditions: The placing of an order will confirm acceptance of the aforementioned conditions.
Conditions stipulated on our Order Form shall be regarded as void, if they are in conflict with our conditions.
12.1 Following any upgrade/repair of “pc component” or “operating system” The PC Centre will not provide any
drivers/patches for that particular “pc component” or “operating system” installed by The PC Centre.
13.0 DIAGNOSTIC/REPAIRING/HARDWARE/SOFTWARE INSTALLATION 13.1 The PC Centre technician will refuse to carry out services on software, hardware or clientware or assistance to
publication, linking, or display of any innapropiate material whether under English law or regulation, the laws or
regulations of the customer country or any other place where the results of such purpose or such material can be
accessed
13.2 The PC Centre technician will refuse to carry out services on software, hardware or clientware or assistance to
the publication, linking to, issue or display of any material which in the absolute discretion of the The PC Centre
may harm The PC Centre or bring The PC Centre into disrepute or may call into action taken by The PC Centre on the
customers behalf.
14.0 FORCE MAJEURE 14.1 The Company shall not be under any liability whatsoever or however arising from any loss or damage which may
be suffered by you as a direct or indirect result of the supply of goods by the Company being prevented, hindered,
delayed or rendered uneconomic by reason of circumstances or events beyond the Companys reasonable control
including but not limited to Act of God, war, riot, strike, lock-out, trade dispute or labour disturbance, accident
breakdown of plant or machinery, fire, flood, storm difficulty or increased expense in obtaining workmen, materials
or transport or other circumstances affecting the supply of Goods or of raw materials therefore by the Companys
normal source of supply or the manufacture of the goods by the Companys normal means or the delivery of the Goods
by the Companys normal route or means of delivery.
14.2 If due to such circumstances or events the Company has insufficient stocks to meet all its commitments the
Company may apportion available stocks between its customers at its sole discretion.
15.0 WARRANTY 15.1 The PC Centre does not give a warranty guarantee protection for:
1) Damage caused by incorrect installation, use, modifications or repair by any unauthorised 3rd party or
yourself;
2) Damage caused by any party (except The PC Centre) or other external force; fitness for any particular
purpose;
3) 3rd Party Products, Software specified by you. You will receive the warranty or licence for these products
directly from their manufacturer or licensor;
